TERMS AND SERVICE CONDITIONS
Last updated: 22 October 2026 · Document: terms-2026-10-22-pdf-only-r15 · Legal release: tmm-de-legal-2026-10-22-pdf-only-separate-leaderboard-rc11
1. Provider, contracting party and scope
David Sewer is the provider and contracting party for the personalised Too Much Money digital trophy. Where a purchase is processed through Stripe Managed Payments, Sold through Link, LLC (SMP) acts as merchant of record for the transaction, payment processing, indirect taxes and transaction support. This does not make SMP the provider of the digital content. Mandatory consumer rights and additional role information shown during checkout remain unaffected.
2. Audience and market
The offer is intended only for adult consumers with a user account. Sales are possible only in countries that have been expressly enabled after technical and legal review. There is no entitlement to have a country enabled.
3. PDF trophy as the sole paid performance
The subject of each one-time purchase is exclusively one newly generated personalised digital trophy recording the profile name at purchase, individual amount, cumulative confirmed total, issue time, unique trophy code and product version. It is supplied exclusively as a PDF and stored in the private account library. A machine-readable record is retained only for internal evidence and security and is not an additional customer product. The leaderboard is neither part of nor consideration for the Trophy purchase. Checkout creates no entitlement to leaderboard participation and publishes no account or payment data.
4. Price
The selectable total price is EUR 1.00 to EUR 100.00 per purchase. The total shown immediately before ordering includes applicable taxes and price components. There are no shipping charges. There is no subscription or automatic renewal.
5. Ordering and contract formation
The user selects the account and trophy amount, can correct input, and separately confirms the displayed product description and required declarations. Stripe Checkout then opens. By activating the final button that unambiguously indicates the obligation to pay, the user submits a binding contractual offer. The digital-trophy contract is concluded on server-side payment confirmation. The immutable contract confirmation is supplied by email as the complete message text and an additional text attachment on a durable medium. The trophy is generated and released for download only after the email provider has technically confirmed delivery. A failed or abandoned checkout creates no trophy.
6. Payment, supply and technical requirements
Accepted payment methods and supply restrictions are shown during checkout. Supply starts only after server-side payment confirmation and after the email provider has confirmed delivery of the contract confirmation on a durable medium. The provider's mere acceptance of the dispatch request is not sufficient for the system to start supply. The digital content is supplied when the personalised PDF file can be downloaded directly; the provider bears the burden of proving supply. The PDF can be opened with common current viewing software, is not executable, requires no installation and has no copy protection or DRM. No account is required to use the locally saved PDF offline. Only the private account library and repeat downloads from it require an account, internet access and a current browser. No particular interoperability with third-party platforms is promised. Technical failures are retried; statutory remedies for non-supply or defective supply remain.
7. Contract language and storage
Contract information is supplied in the approved language selected for the purchase. The documents, declarations, versions and essential order data applicable to the purchase are stored immutably and supplied with the contract confirmation on a durable medium. The user can save the displayed terms before ordering.
8. Separate free leaderboard agreement
After at least one confirmed Trophy purchase, the user may conclude a separate, free leaderboard agreement in the account. It is legally and technically separate from the paid Trophy contract. Only express acceptance of its current terms publishes the alias, rank and confirmed purchase-price total for this product after refunds. The all-time ranking uses all successfully confirmed purchase prices; the rolling 24-hour ranking uses only payments from the preceding 24 hours. Disputed or lost payments do not count. Two Trophys therefore display the sum of both effective purchase prices, and further Trophys increase the total accordingly. Ties are ordered first by the earliest included purchase and then alphabetically by alias without regard to case. Refunds and payment disputes automatically update the displayed total and rank. Participation can be ended at any time for the future, immediately removing the entry. No particular rank, minimum duration or permanent operation is promised.
9. Accounts, leaderboard and private profiles
Purchases require an approved account. Profile name, display name and optional bio are used for personalisation. The profile, bio, email, trophies, individual purchase events, payment data and internal moderation data remain non-public. Checkout gives no publication consent. Only under the separate leaderboard agreement are the alias, rank and resulting confirmed purchase-price total after refunds displayed publicly. No profile or trophy gallery and no external profile links are offered.
10. Rights in profile content and alias display
Users retain their rights in submitted content and grant the provider only the non-exclusive licence necessary to operate, personalise, perform the contract and moderate the private profile for the duration of the service. For voluntary public leaderboard display, this licence covers the approved alias together with rank and confirmed purchase-price total while the separate leaderboard agreement remains active. Users may submit only content for which they hold the required rights.
11. Moderation and measures
Content may be checked automatically and by humans. Depending on content and severity, a bio may be hidden, a profile rejected or restricted, and an account suspended for severe or repeated breaches. Decisions are explained and affected users may use the provided appeal route. Details are set out in the Community Rules.
12. No cash value, prize, investment or sponsorship
Neither trophy nor rank is credit or e-money; neither is transferable or redeemable. The leaderboard awards no prize and conveys no chance of winning or cash value. A trophy purchase is not a tax-deductible donation, investment or sponsorship.
13. Local storage, repeat access and updates
Users should save the supplied PDF locally without delay; the locally saved file has no technical expiry date. Repeat access from the private account library is offered only while the service operates. Indefinite operation, cloud storage or repeat access is not promised. New purchases will stop before a planned permanent shutdown. The static PDF file contains no software to install and routine functional updates are not planned. Where updates, including security updates, are required to keep the trophy in conformity, they will be supplied and notified for at least two years after supply and beyond that throughout the period required by section 327f of the German Civil Code. Mandatory rights for digital products remain unaffected.
14. Statutory remedies and liability
Statutory rights for failure to supply or defects in digital products and statutory liability apply. Nothing in these terms limits claims for intent, gross negligence, injury to life, body or health, product liability, or other rights that cannot lawfully be limited.
15. Withdrawal
The paid contract concerns exclusively the PDF Trophy as digital content not supplied on a tangible medium. The right of withdrawal for that digital content expires only when supply begins and only where the consumer first expressly consented to supply before the end of the withdrawal period, acknowledged the resulting loss of that right and received the required contract confirmation on a durable medium. The separate free leaderboard agreement is not part of this purchase contract. If any condition is missing, Trophy supply must not begin; if it nevertheless begins, early expiry does not occur and the statutory withdrawal route remains available.

17. Consumer dispute resolution
The provider is neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration body. After an unresolved dispute arises, the information required by law will be provided in text form.
